AURAXIO ESIGN ACT DISCLOSURE

ELECTRONIC SIGNATURE DISCLOSURE AND CONSENT

This disclosure explains your rights regarding electronic signatures on the Auraxio platform. Please read it carefully before signing any document through Auraxio.


1. LEGAL EFFECT OF ELECTRONIC SIGNATURES

Electronic signatures on the Auraxio platform are legally binding and have the same legal effect as handwritten (ink) signatures under:

  • The Electronic Signatures in Global and National Commerce Act (ESIGN Act), 15 U.S.C. § 7001 et seq. — Federal law establishing the validity of electronic signatures in the United States
  • The Uniform Electronic Transactions Act (UETA) — Adopted in Texas, California, and Florida, establishing electronic signatures as equivalent to handwritten signatures for real estate transactions
  • Texas Business & Commerce Code Chapter 322 — Texas adoption of UETA
  • California Civil Code § 1633.1 et seq. — California adoption of UETA
  • Florida Statutes § 668.50 — Florida adoption of UETA

A buyer representation agreement signed electronically through Auraxio is a valid, enforceable legal contract. By signing, you are entering into a binding legal agreement with your real estate agent's brokerage.


2. CONSENT TO ELECTRONIC SIGNATURES

By drawing your signature and tapping "Submit and Sign" on the Auraxio signing page, you:

2.1 Affirmatively consent to the use of electronic signatures and electronic records for this buyer representation agreement and all related disclosures

2.2 Acknowledge that you have read and understand the agreement you are signing

2.3 Confirm that your drawn signature represents your signature and that you intend to sign the agreement

2.4 Agree that the electronic version of this agreement, together with the audit trail generated at the time of signing, constitutes the original signed document


3. WHAT AURAXIO RECORDS AT SIGNING

To establish and preserve the legal validity of your electronic signature, Auraxio records the following information at the moment you sign:

This information is stored permanently as part of the signed agreement's audit trail. It is encrypted at rest and is accessible to the agent who sent the agreement and to Auraxio for legal compliance purposes.


4. HARDWARE AND SOFTWARE REQUIREMENTS

To sign an Auraxio document electronically, you need:

  • A device with a touchscreen (smartphone, tablet) or a mouse/trackpad (computer)
  • A modern web browser:
    • Apple Safari (iOS 14+ or macOS 11+)
    • Google Chrome (version 90+)
    • Mozilla Firefox (version 88+)
    • Microsoft Edge (version 90+)
    • Samsung Internet (version 14+)
  • An active internet connection
  • The ability to receive and open SMS text messages (to receive the signing link)

No additional software, app downloads, or account creation is required to sign an Auraxio document as a buyer.


5. HOW TO WITHDRAW CONSENT

You have the right to withdraw your consent to use electronic signatures at any time before completing the signing process.

Before signing: Simply close the signing page without submitting your signature. No agreement will be recorded.

After signing: An electronic signature, once submitted and confirmed, cannot be unilaterally withdrawn. If you signed in error or wish to discuss the agreement, contact your real estate agent directly using their contact information.

To receive a paper copy instead: Contact your real estate agent and request that they provide you with a paper copy of the agreement for wet (handwritten) signature. There is no fee for requesting a paper alternative.


6. REQUESTING PAPER RECORDS

You may request a paper copy of any electronically signed agreement at no charge by:

  • Downloading the signed PDF directly from the signing confirmation page
  • Contacting your real estate agent and requesting they email or print a copy for you
  • Contacting Auraxio at support@auraxio.com with your agent's name and your agreement ID (shown on the confirmation screen after signing)

7. KEEPING YOUR RECORDS

After signing, Auraxio:

  • Immediately generates a signed PDF incorporating your signature and audit trail
  • Makes the signed PDF available for download from the signing confirmation page
  • Stores the signed PDF permanently in the agent's legal vault
  • Keeps your unique signing link accessible so you can return to view or download your signed copy at any time

We recommend downloading a copy of your signed agreement immediately after signing and saving it for your personal records.


8. SCOPE OF THIS DISCLOSURE

This disclosure applies to:

  • Buyer representation agreements (all types: full representation, showing only, non-exclusive, etc.)
  • All states served by Auraxio: Texas, California, and Florida
  • All document types generated and delivered through the Auraxio platform

  • You are signing a real legal contract with your real estate agent's brokerage
  • Your signature has the same legal force as if you signed with a pen
  • Auraxio records the date, time, your IP address, and your device to prove you signed
  • You can download a copy of the signed document immediately
  • The link stays active so you can come back and download your copy later
  • If you have questions about what you are signing — ask your agent before you sign

This ESIGN Disclosure was prepared in compliance with 15 U.S.C. § 7001(c), which requires that electronic signature consent be informed, affirmative, and in a form that can be retained by the consumer.
